TOWN OF CONCORD PLAN COMMISSION MINUTES

November 19, 2025

The meeting was called to order at 7:00 p.m. with Plan Commission members Sally Williams, Dave Wegner, Tony Metzger, Dale Konle and Duwayne Hunt present. Town chair Ted Mueller and Town supervisors Kim Herro and Kim Miller were also present.

Sally Williams stated that the meeting had been properly posted.

Tony Metzger made a motion to approve the minutes from the October 29, 2025 meeting, second by Dave Wegner. All approved. Motion passed. 

Item 1: Michael Laylan requested review and approval of a preliminary CSM to create (2) prime 1-acre A-3 lots south of N6625 Elm Drive from a 77-acre parent parcel (pins 006-0716-1144-000 & 006-0716-1141-000). Sally Williams made a motion to recommend approval of the petition as presented. Second by Dale Konle. All approved. Motion passed.

Item 2: Discussion of annexation concerns with Brian Sajdak of Stafford Rosenbaum.

Summary:

Boundary agreements: There is not a lot the town can do to prevent annexation. Boundary agreements can be pursued. Under 66.0301, a General Intergovernmental Agreement can last 10 years. Under 66.0307, a Cooperative Boundary Agreement would last > 10 years with no maximum time frame. Border agreements can also arise from incorporation or annexation disputes.

Incorporation: the town may qualify as an “isolated village” – an area of at least ½ square mile with a population of 150. Would need to be approved as such by the Department of Administration. That area of the town could then petition for incorporation. Once incorporated, it could not annex more land 5 years unless there is unanimous approval of land owners, but could “consolidate” the remaining town and the village under 66.02165. A village does not need to provide sewer and water. Other required services are based on population. A village does control its own zoning so would need to develop its own zoning code. Process to incorporate takes about 1 year.

Annexation generally starts with a petition from the property owner(s) although it can be initiated by a municipality. A village or city could also initiate annexation through a referendum. Often done to access sewer and water for development. The town would get notice and can review the petition for accuracy, etc. Town would need to approve annexation across county line unless the area being annexed had unanimous approval of the landowners involved.

Preemptive development: This may be the best way to make annexation less desirable. May protect I94 corridor up to river by allowing some sort of more dense development. Consider light industrial, large lot subdivisions. Hire municipal planner or real estate expert.

Purchase of Development Rights – this may make annexation less desirable but it could still be annexed. Would need to come up with funding.

The next meeting will be December 17. If there are no petitions the meeting will be canceled.
