11.01 BOARD OF HEALTH. (1) DUTIES. The Board of Health shall
assume the general administration of health and sanitation laws and regulations in the
Town, supervise the work of the Health Officer and attend to the administration and
enforcement of the health laws of the State and the rules and regulations prescribed
by the State Department of Health and Social Services and the ordinances of the Town.
(2) POWERS. The Board may take such measures and make such rules and
regulations as are necessary and effectual for the preservation and promotion of the
public health in the Town. All orders and regulations of the Board shall be published
in the official newspaper and, after publication, shall have the force and effect of
ordinances, including penalty for violation.
11.02 HEALTH OFFICER: DUTIES AND POWERS. (1) GENERAL DUTIES.
The Health Officer, under the supervision of the District State Health Officer, shall:
(a) Maintain continuous sanitary supervision over his territory.
(b) Promote the spread of information as to the cause, nature and prevention
of prevalent diseases and the preservation and improvement of health.
(c) Enforce the health laws, rules and regulations of the State Department
of Health and Social Services, the State and the Town, including the laws relating to
contagious diseases contained in Ch. 143, Wis. Stats.
(d) Take steps necessary to secure prompt and full reports by physicians
of communicable diseases and prompt and full registration of births and deaths.
(e) Keep and deliver to his successor a record of all his official acts.
(f) Make annual reports to the State Department of Health and Social
Services and to the Town Board, and such other reports as they may request.
(2) MATERIALS AND SUPPLIES. The Health Officer may procure at the
expense of the Town all record books, quarantine cards and other materials needed by
the Board of Health, except those furnished by the State Department of Health and
Social Services.
11.03 RULES AND REGULATIONS. The Health Officer and the Board of
Health may make reasonable and general rules for the enforcement of this chapter,
for the prevention of health nuisances and for the protection of the public health and
welfare and may, where appropriate, require the issuance of licenses and permits. All
such requirements when approved by the Town Board shall have the same effect as
ordinances, and any person violating any of such regulations or any lawful order of the
Board shall be subject to a penalty as provided in Sec. 25.04 of this Municipal Code.
11.04 HEALTH NUISANCES, ABATEMENT OF. The Health Officer or the
Board of Health may abate health nuisances in accordance with Sec. 146.14, Wis. Stats.,
which is adopted by reference and made a part of this chapter as if fully set forth herein.
11.05 COMMUNICABLE DISEASES. Ch. 143, Wis. Stats., and Ch. H 45,
Wis. Adm. Code, are adopted by reference and made a part of this chapter; and the
Health Officer shall enforce the provisions thereof.
11.06 MILK AND MILK PRODUCTS. (1) GRADE A MILK REQUIRED.
No person shall sell, offer or expose for sale within the Board any milk or milk product
other than Grade A pasteurized milk or milk products as defined in Ch. AG 80, Wis.
Adm. Code.
(2) FROZEN DESSERTS. The provisions of Ch. AG 70, Wis. Adm. Code,
relating to frozen desserts, exclusive of any provision thereof relating to the penalty,
is hereby adopted and made a part of this chapter by reference. A violation of any
such provisions shall constitute a violation of this chapter.
11.07 CONTROL OF TOWN DUMP. The Town dump shall be open for the
deposit of rubbish to residents of the Town only. No person shall deposit any dead
animals or portions thereof or any dead birds, fowl, garbage or other vegetable material
or paper into the dump.
11.08 REGULATION OF NUISANCE-TYPE BUSINESSES. (1) STATUTORY
AUTHORIZATOIN. This section is enacted pursuant to Sec. 66.052, Wis. Stats.
(2) PERMIT REQUIRED. No person shall conduct within the Town any
business which has a tendency to create a public nuisance, except upon permit issued
by the Health Officer and subject to such conditions as he may impose.
(3) DEFINITION. A "business which has a tendency to create a public
nuisance" is one which, unless properly regulated, may create a public nuisance as defined
in Sec. 10.02 of this Municipal Code.
11.09 PENALTY. Any person who shall violate any provision of this chapter
or any regulation, rule or order made hereunder shall be subject to a penalty as provided
in Sec. 25.04 of this Municipal Code.
